The domain name(s) through which you have accessed the Portal is (are) owned by the Entity. Said domain name(s) may not be used in connection with other content, products and/or services that are not owned by the Entity or in a manner that may cause confusion among end users or discredit the Entity. 

2. PURPOSE.

This Legal Notice includes the general conditions that regulate access, browsing and use of the Portal, as well as the contents that comprise it, without prejudice to the fact that the Entity may establish specific conditions that regulate the use, provision and/or contracting of the products or services that, where appropriate, may be offered through the Portal.

In the event of being offered, through the Portal, the use, provision and/or contracting of products or services, the fact of being used and/or requested by the User shall also imply the unreserved acceptance of the particular conditions which, where applicable, have been established for this purpose, and which shall form an integral part of this Legal Notice.

The Entity reserves the right to offer certain products or services exclusively to Users registered through the Portal and who expressly accept the particular conditions that may be applicable.

The Entity reserves the right to terminate, modify, suspend or interrupt, temporarily or indefinitely, at any time and without prior notice, access to the products, services and/or contents of the Portal, as well as the configuration of the Portal, services, products, services and contents, without the User being able to claim or demand any compensation; in particular, for maintenance, repair, updating, improvement and/or adaptation to technical, operational and/or legal changes. After such termination, the prohibitions, restrictions and limitations contained in this Legal Notice and/or in any applicable specific conditions shall remain in force.

3. ACCESS AND USE OF THE PORTAL.

The mere access to the Portal, the use of the contents offered therein, as well as the completion of forms, the sending of requests for information, queries, complaints and, in general, any act of a similar nature to the above (especially if carried out through the existing means on the Portal) will imply, on the part of those who browse the Portal, the acquisition of the consideration of User and the acceptance, without reservation, of each and every one of the rules included in this Legal Notice. Consequently, all Users must carefully read and understand the contents of this Legal Notice.

Unless expressly stated otherwise, access to and use of the Portal by Users is free of charge. Nevertheless, the Entity reserves the exclusive right to decide whether access to and use of the products or services offered through the Portal shall be free of charge or whether, on the contrary, it decides to demand a financial consideration for this, in which case the amount, method of payment and other particular conditions that may be applicable shall be expressly notified to Users prior to their coming into force, so that Users may voluntarily desist from accessing and/or using those products or services that involve the payment of any amount. Once the corresponding particular conditions come into force, access to and/or use of the products or services by the User shall imply the express acceptance of the particular conditions. 

The use, provision and/or contracting of the products or services which, where applicable, may be offered by the Entity may be subject to the prior observance of formal requirements such as prior registration, the completion of forms, formalising the subscription to the same, the payment of charges or fees and/or the prior acceptance of the particular conditions which may be applicable to the same. 

If, in order to use, provide and/or contract any product or service offered through the Portal, the User must register, he/she shall be responsible for providing truthful and lawful information, guaranteeing the authenticity of all the data entered when filling in the pre-established forms to access the products or services in question. If, as a consequence of registration, the User has to use a password, he/she undertakes to use it diligently and to keep it confidential. Consequently, Users are responsible for the proper custody and confidentiality of any identifiers and/or passwords supplied to them by the Entity, and undertake not to cede their use to third parties, whether temporary or permanent, nor to allow their use by third parties. The use and/or contracting of the products or services offered on the Portal by any third party who illegitimately uses a password or identifier supplied to the User for this purpose, when this occurs as a result of a non-diligent action or the loss of the same by the User, shall be the sole responsibility of the User, unless the User has immediately informed the Entity. 

By virtue of the above, it is the User's obligation to immediately notify the Entity of any event that makes possible the improper use of the identifiers and/or passwords, such as theft, loss, or unauthorised access to them by third parties, in order to proceed to their immediate cancellation. Until such events are communicated, the Entity shall be exempt from any liability that may arise from the improper use of identifiers or passwords by unauthorised third parties. 

In any case, access, browsing and use of the Portal and, where appropriate, the use or contracting of the products or services offered through the Portal is the sole and exclusive responsibility of the User, who therefore undertakes to diligently and faithfully observe any additional instructions given by the Entity or by authorised personnel of the Entity regarding the use of the Portal and its contents.

Therefore, the User undertakes to use the contents, products and services in a diligent, correct and lawful manner, in accordance with the legislation in force and, in particular, undertakes to refrain from: 

· Use them for purposes or effects contrary to the law, morality, generally accepted good practices or public order and the instructions received from the Entity.

· Using them for purposes prejudicial to the legitimate rights of third parties.

· To use the contents and products obtained through the Portal or the services to send advertising, communications for direct sales purposes or for any other commercial purpose, unsolicited messages addressed to a number of people regardless of their purpose, as well as to refrain from commercialising or disclosing this information in any way, except when previously and expressly authorised by the Entity.

4. RESPONSIBILITIES, WARRANTIES AND DISCLAIMERS.

The Entity is not responsible for and, to the maximum extent permitted by applicable law, excludes any warranties, express or implied, regarding the merchantability, fitness for a particular purpose, non-compliance, accuracy, reliability, completeness or timeliness of the content, services, products or other items included on the Portal, or the results obtained from accessing and using the Portal and/or the content thereof. The Portal and any content, products and/or services offered within the Portal are offered "as is". The User is aware and voluntarily accepts that the use of the information published and/or provided in relation to the products or services of the Portal takes place under his/her sole and exclusive responsibility.

In particular, to the maximum extent permitted by applicable law, the Entity does not guarantee or accept any liability for: 

· The continuity of the contents of the Portal and/or the lack of availability or accessibility of the Portal or technical continuity of the same; 

· The existence of interruptions or errors in access to the Portal, as well as technical problems or failures that occur during the Internet connection;

· The absence of errors or inaccuracies in content, services or products; 

· The absence of viruses and other harmful components on the Portal or on the server that provides it; 

· The invulnerability of the Portal and/or the impregnability of the security measures adopted therein; 

· The reliability and/or suitability, for a particular purpose or purpose, of the Portal, of the products or services incorporated therein, and of the information published and/or provided in relation to such products or services; 

· If applicable, the lack of usefulness, benefit or performance of the contents or services of the Portal; 

· Damage or harm caused, to themselves or to a third party, by any person who infringes the conditions, rules and instructions established by the Entity on the Portal or through the violation of the Portal's security systems; 

· Any other damage that may be caused by reasons inherent to the non-functioning or defective functioning of the Portal or of the websites to which, where appropriate, links may have been established (links).

5. PROHIBITIONS AND RESTRICTIONS.

Any communication or transmission of content that infringes the rights of third parties and/or whose content is threatening, obscene, defamatory, defamatory, pornographic, xenophobic, offensive to the dignity of the person or the rights of children, the law in force or any conduct that incites or constitutes the commission of a criminal offence is prohibited. 
Likewise, the inclusion and communication of content by Users that is false or inaccurate and that induces or could induce other Users or the Entity's personnel to error, in particular content that is protected by any intellectual, industrial, image or similar property rights belonging to third parties, when this results in a violation of current legislation, is also prohibited, do not have the authorisation of the holder of the rights, undermine or discredit the fame or credit of the Entity, are considered as a case of illicit, misleading or unfair advertising and/or incorporate viruses or any other electronic element that could damage or impede the operation of the Portal, the network, computer equipment of the Entity or third parties and/or access to the Portal by the rest of the users.
If the User violates the above prohibitions/restrictions, or the Entity has or may have reasonable grounds to suspect that a User has violated any of them, the Entity reserves the right to suspend or terminate the User's account and deny any current or future access to and use of the products, services and/or the Portal (or any part thereof).

6. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS.

All intellectual and industrial property rights over the contents of the Portal are reserved and, in particular, it is forbidden to modify, copy, reproduce, publicly communicate, transform or distribute in any way all or part of the contents included in the Portal, for public or commercial purposes, without the prior, express and written authorisation of the Entity or, where appropriate, of the owner of the corresponding rights. 
The User's access to and browsing of the Portal, as well as access to and use of the services or products offered, shall in no case be understood as a waiver, transmission, licence or total or partial transfer of the aforementioned rights by the Entity, except where expressly established otherwise in the specific conditions that regulate the use, provision and/or contracting of the products or services that, where applicable, are offered through the Portal. Consequently, it is not permitted to remove, evade or manipulate the copyright notice and any other data identifying the rights of the Entity or its owners, incorporated into the contents, as well as the technical protection devices, digital fingerprints or any information and/or identification mechanisms that may be contained therein. 
References to names and commercial or registered trademarks, logos or other distinctive signs, whether owned by the Entity or by third parties, imply a prohibition on their use without the prior, express and written consent of the Entity or of their legitimate owners. Under no circumstances, unless expressly stated to the contrary, does access to or use of the Portal and/or its contents give the User any right over the brands, logos and/or distinctive signs incorporated therein.
The use, exploitation and/or unauthorised use of the contents of the Portal, as well as any act of a similar nature that may result in a breach of intellectual or industrial property rights, will give rise to the legally established responsibilities.

7. LINKS.

7.1 Links from the Portal to other websites.

The Entity may offer links, directly or indirectly, to Internet resources or web pages outside the Portal. The presence of these links on the Portal is for information purposes and in no case constitutes an invitation to contract products and/or services that are offered or may be offered on the destination web pages, nor does it imply the existence of a relationship of dependence with the entity that owns the linked web page. In these cases, the Entity shall not be responsible for establishing the terms and conditions to be taken into account in the use, provision and/or contracting of these services by said third parties and, therefore, cannot be held responsible for them.

The Entity has neither the power nor the human or technical means to know, control or approve all the information, content, products or services provided by other websites to which links may be established from the Portal. Consequently, the Entity cannot assume any type of responsibility for any aspect related to the web pages to which a link may be established from the Portal. 

Nevertheless, in the event that the Entity becomes aware that the activity or information to which it refers from these links is illicit, constitutes a crime or may damage the property or rights of a third party, it will act with the necessary diligence to remove or disable the corresponding link as soon as possible. 

Likewise, if Users have actual knowledge of the unlawfulness of activities carried out through these third-party websites, they must immediately notify the Entity so that it may proceed to analyse the particular situation and, if appropriate, disable the access link to the same.

For the avoidance of doubt, the fact that when accessing a specific web page there is a "frame" or "frame" on the upper part of which the name or logo of the Entity appears, in no case implies that the Entity is the owner or holder of said web pages, the owners and holders of the web pages being those who appear identified as such on the same.

7.2 Links from other websites to the Portal.

If any User, entity or web page wishes to establish any type of link to the Portal, the following requirements must be observed: 

· Prior express written authorisation must be obtained from the Entity.

· The link may only lead to the home page of the Portal, unless expressly authorised otherwise. 

· The link must be absolute and complete, that is to say, it must take the User, by means of a click, to the home page and must completely cover the entire extension of the screen of the Portal's home page. Under no circumstances, unless otherwise authorised by the Entity, may the website from which the link is made reproduce the Portal in any way, include it as part of its website or within one of its frames or create a browser on any of the pages of the Portal. 

· The website from which the link is established may not state in any way that the Entity has authorised such a link, without this having been the case. If the entity that makes the link from its website to the Portal correctly wishes to include on its website the brand, denomination, commercial name, label, logo or any other identifying sign of the Entity and/or the Portal, it must first have the prior, express and written authorisation of the Entity. 

· In any case, the Entity prohibits the establishment of a link to the Portal from those web pages that contain materials, information or contents that are illicit, illegal, degrading, obscene and, in general, that contravene morality, public order, current legislation, generally accepted social norms, are harmful to the legitimate rights of the Entity or third parties or that in any way may affect or damage the good image and reputation of the Entity. 

8. PRIVACY POLICY.

When it is necessary for the User to register or provide personal data, he/she will be duly informed of this need. 
In any case, the collection and processing of personal data will be carried out subject to the principles and obligations of the applicable data protection regulations, and in accordance with the provisions of the Privacy Policy, which forms an integral part of this Legal Notice.

9. DURATION AND MODIFICATION.

The Entity reserves the right to modify this Legal Notice and/or the particular conditions that, where appropriate, have been established for the use and/or contracting of the products or services provided through the Portal, when necessary in order to adapt to legislative, business and/or technological changes. The updated texts will be valid and will take effect from their publication on the Portal or, where appropriate, once the Users have been notified in accordance with the terms set out in the aforementioned notification.

The temporary validity of this Legal Notice coincides, therefore, with the time of its exposure, until it is totally or partially modified, at which time the updated texts will come into effect. 

10. COMMUNICATIONS.

For any communication between the Entity and the User, the User must contact the Entity through the means of contact indicated above, preferably by electronic means. In any case, and unless the law expressly determines otherwise, communications from the Entity to the User shall preferably be made electronically, using the contact details provided. The User expressly accepts the use of electronic mail as a valid procedure for the exchange of information and the sending of communications between and/or with the Entity.

11. GENERAL.

The headings of the different clauses are for information purposes only, and shall not affect, qualify or modify the interpretation of the Legal Notice. 

In the event of any discrepancy between the provisions of this Legal Notice and the particular conditions that, where applicable, may be established with respect to the products or services offered on the Portal, the provisions of the particular conditions shall prevail with respect to the products or services subject to said particular conditions. 

In the event that any provision or provisions of this Legal Notice should be considered null and void or inapplicable, in whole or in part, by any Court, Tribunal or competent administrative body, such nullity or inapplicability shall not affect the other provisions of the Legal Notice or the particular conditions that, where appropriate, may have been established. 

The non-exercise or non-execution by the Entity of any right or action recognised in this Legal Notice shall not constitute a waiver thereof, unless acknowledged and agreed in writing by the Entity. 

12. APPLICABLE LAW AND COMPETENT COURTS.

This Legal Notice and any relationship arising from its acceptance or related to it shall be governed exclusively by the applicable Spanish legislation. 

The Parties, expressly waiving any other jurisdiction to which they may be entitled, agree to submit to the exclusive jurisdiction of the courts of the city of Madrid (Spain), which shall have exclusive competence to hear and resolve any dispute arising from or related to this Legal Notice and/or any relationship arising from the acceptance of the same. Each of the parties hereby consents to the exclusive jurisdiction of such courts.
